Procedure for issuing permits by the State Labor Service for performing high-risk work and for operating (using) high-risk machines! mechanisms! and equipment
On January 24! 2024! the Supreme Court! as part of the Cassation Administrative Procedure for issuing Court! in case No. 480/2681/20! administrative proceedings No. K/9901/37292/21 (EDRSRU No. 116520672)! investigated the issue of the procedure for issuing or refusing to issue! reissuing! or canceling permits by the State Labor Service and its territorial bodies for country email list performing hazardous work and for operating (using) hazardous machines! mechanisms! and equipment.
In accordance with Part Three of Article 21 of Law No. 2694-XII
the employer must obtain a permit to Procedure for issuing perform high-risk work and to operate (use) high-risk machines! mechanisms! and equipment (hereinafter referred to as the permit).
The procedure for issuing or refusing to issue! reissuing! or canceling permits for performing high-risk work and for operating (using) high-risk machines! mechanisms! and equipment (hereinafter referred to as the advantages and disadvantages of external sales permit) by the State Labor Service and its territorial bodies is determined by the Procedure for Issuing Permits for Performing High-risk Work and for Operating (Using) High-risk Machines! Mechanisms! and Equipment! approved by Resolution of the Cabinet of Ministers of Ukraine dated October 26! 2011 No. 1107 (hereinafter referred to as the Procedure No. 1107).
In accordance with paragraphs 6! 7 of Procedure No. 1107
(as amended at the time of the occurrence of the disputed legal relationship)! a permit in the form in accordance with Appendix 1 is issued: to an employer to perform high-risk work specified in Appendix 2! or to operate high-risk machines! mechanisms! equipment specified in Appendix 3; to a manufacturer or supplier of high-risk machines! mechanisms! equipment (hereinafter referred to as aol email list the manufacturer or supplier) – to use high-risk machines! mechanisms! equipment specified in Appendix 3! if another form of assessment of its conformity! which is a mandatory requirement for it! is not established by technical regulations.
